Privacy Policy

Daily Mentoring Pty Ltd, trading as Local Views (we, us or our), understands that protecting your personal information is important. This Privacy Policy sets out our commitment to protecting the privacy of personal information provided to us, or collected by us, when interacting with you, including through this website (localviews.ai).
It covers everyone we hold information about: business owners who apply to or join a Local Views program, and the food creators we book into those businesses through Creator Visits. If you are a creator, the Creator Visits section below is the one written for you, and it applies on top of everything else here.
The information we collect
Personal information: is information or an opinion, whether true or not and whether recorded in a material form or not, about an individual who is identified or reasonably identifiable.
The types of personal information we may collect about you include:
- Identity Data, including your name, age, and gender.
- Contact Data, including your telephone number, address and email.
- Business Data, including the name of your business, its location, links you provide to your business's social media accounts or listings (such as an Instagram username or Google Maps link), and information about your business's revenue, age, and goals that you provide in our application forms.
- Financial Data, including bank account and payment card details (through our third-party payment processor, who stores such information; we do not have access to that information).
- Transaction Data, including details about payments to you from us and from you to us and other details of products and services you have purchased from us.
- Technical and Usage Data, which we collect when you access our website: details about your internet protocol (IP) address, browser session and geo-location data, statistics on page views and sessions, device and network information, acquisition sources, and browsing behaviour (including through the use of Internet cookies and analytics).
- Profile Data, including your username and password for any Local Views client dashboard we provide, content you send and share with us as part of the program (such as video clips you film), and support requests you have made.
- Interaction Data, including information you provide to us when you book a call with us, participate in surveys, promotions, activities or events.
- Marketing and Communications Data, including your preferences in receiving marketing from us and our third parties and your communication preferences.
- Creator Data, for creators who sign up to Creator Visits: your first name, your Australian mobile number, your city and the suburbs you can get to, your TikTok and Instagram handles, your email address if you give us one, the cuisines you cover, and a record of the consent you ticked, including its exact wording and when you ticked it.
- Creator Pool Data, for creators we have shortlisted but not contacted: your public handle, your public bio (including an email address or a second handle if you have put one in it), your follower count, and the captions, links and view counts of recent public posts, together with a note from the model we use to score whether you look like a local food creator in that city.
- Visit and Message Data, including the text messages between you and us, which venue you were invited to and when you are booked, how many people are coming, whether the visit happened, anything you ask us to remember for next time, and the caption, link and view count of the post you publish after a visit.
Sensitive information is a sub-set of personal information that is given a higher level of protection. We do not ask for sensitive information on any of our forms. One kind still reaches us: if you are a creator and you tell us about a food allergy or a dietary requirement before a visit, that is health information, and health information is sensitive information under the Privacy Act 1988 (Cth). We collect it because you have chosen to tell us, we hold it with your creator record, and we pass it to the venue you are booked into so the kitchen can cook for you on the day. We do not use it for anything else. If at any time we need to collect other sensitive information about you, unless otherwise permitted by law, we will first obtain your consent and we will only use it as required or authorised by law.
How we collect personal information
- when you interact directly with us, including face-to-face, over the phone, over email, or online;
- when you complete a form on our website, such as an application form, or when you book a call with us through our scheduling tools;
- from third parties, such as details of your use of our website from our analytics, cookie and marketing providers (see the “Cookies and tracking technologies” section below), or our customer relationship management (CRM) and scheduling providers;
- when you sign up as a creator at app.localviews.ai/creators/join, and afterwards when you text us or reply to a text from us about a visit;
- from publicly available sources, such as social media profiles or business listings. Some of these you link us to. Others, such as the public creator profiles described under Creator Visits below, we find ourselves, through a third-party collection service (Apify) that gathers public posts and profile information from TikTok and Instagram for us; or
- from a creator's public post after a visit, to check the post went up and to read its view count.
Why we collect, hold, use and disclose personal information
- to assess your application to join a Local Views program and to do business with you;
- to contact and communicate with you about our services, including in response to enquiries and to schedule and run calls with you;
- to provide our services to you, including reviewing footage you send us and producing content for your business;
- for internal record keeping, administrative, invoicing and billing purposes;
- for analytics, market research and business development, including to operate and improve our website and services;
- for advertising and marketing, including to measure the performance of our advertising and to send you promotional information we consider may be of interest to you;
- to run Creator Visits, which means shortlisting creators, inviting them, booking visits, confirming and reminding, checking that the post went up and carried the disclosure tag, and reporting the results to the venue;
- to keep a record of who consented to be texted and who has opted out, so that we stop when you tell us to;
- to comply with our legal obligations or if otherwise required or authorised by law.
Our disclosures of personal information to third parties
We may disclose personal information to:
- our employees, contractors and/or related entities (including Daily Mentor);
- IT service providers, data storage, web-hosting and server providers;
- customer relationship management, form and scheduling providers (such as HubSpot and our call-booking tools);
- marketing or advertising providers (such as Meta and Google; see the “Cookies and tracking technologies” section below);
- venues a creator is booked into, as set out in the Creator Visits section below;
- messaging and email providers (Twilio for text messages, Resend for email);
- Anthropic, whose API drafts the messages our creator messaging agent sends, which means the conversation is sent to Anthropic so it can produce the next message;
- data collection providers (Apify), which collects public TikTok and Instagram posts and profiles for us;
- automation providers we use to connect the tools above;
- professional advisors, bankers, auditors, our insurers and insurance brokers;
- payment systems operators or processors;
- our existing or potential agents or business partners;
- anyone to whom our business or assets (or any part of them) are, or may (in good faith) be, transferred;
- courts, tribunals, regulatory authorities and law enforcement officers, as required or authorised by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights; and
- any other third parties as required or permitted by law, such as where we receive a subpoena.
Overseas disclosure
While we store personal information in Australia, where we disclose your personal information to the third parties listed above, these third parties may store, transfer or access personal information outside of Australia. We will only disclose your personal information overseas in accordance with the Australian Privacy Principles. The providers we use to run Creator Visits, including Twilio, Resend, Anthropic and Apify, are based outside Australia, so the messages, contact details and public profile information we send them are handled overseas.
Creator Visits
Creator Visits is the part of Local Views where we book local food creators into a client venue for a meal, and the creator posts about it afterwards. It runs on personal information the rest of this policy does not describe, so we set it out here on its own. All of it is handled under the Australian Privacy Principles, the same as everything else in this policy.
Signing up as a creator
You sign up at app.localviews.ai/creators/join. The form asks for your first name, your Australian mobile number, your city and the suburbs you can get to, your TikTok and Instagram handles, and the cuisines you cover. Your email address is optional. You also tick a box agreeing that we can text you about creator visits. We store the exact wording you agreed to and the time you agreed to it, because the Spam Act 2003 (Cth) requires us to keep a record of consent.
How we message you
After you sign up, the program runs over text messages: a welcome, invites to a venue near you, the times you can choose from, your booking confirmation, a reminder the day before, and a follow-up if your post has not gone up yet. Those texts go through Twilio, our SMS provider, and any email we send you goes through Resend, our email provider. The messages are drafted by software using Anthropic's API, so your conversation is sent to Anthropic to produce the next message. Local Views staff can read the whole conversation in an internal dashboard, and staff review some messages before they are sent.
Creators we have not contacted yet
Before we invite anyone, we build a pool of possible creators for each city we work in. We collect public posts and profiles from TikTok and Instagram through Apify, a third party that does the collecting for us. What we keep is what anyone can see on the profile: your handle, your bio (including an email address or a second handle if you have put one there), your follower count, and the captions, links and view counts of recent posts. We then score that information with a model to judge whether you look like a local food creator in that city, and we keep the note it produced so that a person can check the decision later.
Being in that pool is not the same as signing up. Most of the people in it have never been contacted by us, and many never will be. We hold no phone number for you unless you fill in the join form yourself. If you are in the pool and would rather not be, email creators@localviews.ai with your handle and we will remove you.
Checking your post after a visit
For up to two weeks after a visit we look at your public post to check that it went up and that it carries the disclosure tag we asked for, such as #gifted. We read two things: the caption, which tells us the venue is tagged and the post is disclosed, and the view count, which goes into the venue's monthly report so the venue can see how the posts performed. We only look at posts you have made public. We do not see the private analytics inside your TikTok or Instagram account.
What the venue sees, and what we hold about venues
The venue you are booked into is told your first name, your handle, the time you are booked and how many people are coming, along with any note you have given us about the booking. If you have told us about a food allergy or a dietary requirement, we pass it to that venue so the kitchen can cook for you on the day, and for no other reason. That information is health information, so it gets the higher level of protection sensitive information is given under the Australian Privacy Principles. Our booking notices to a venue do not include your phone number or your email address.
On the venue side, we hold the owner's name, email address and mobile number. We use them to tell the venue when a visit is booked, moved or cancelled, to remind the venue before it, and to send a weekly summary of what is coming up and what has been posted.
Stopping the messages, and asking for your information
To stop the texts. Reply STOP to the number we message you from. That stops the messages for good, and nothing starts again unless you text START. Stopping the texts does not delete what we already hold.
To see, correct or delete what we hold. Email creators@localviews.ai. We keep creator information while you are on the program, and after that we keep it until you ask us to delete it. Nothing is deleted automatically on a schedule at the moment, so if you want yours gone, ask us. We will delete what we hold, apart from anything we have to keep by law and the record that you opted out, which we keep so that we do not text you again by mistake.
Your rights and controlling your personal information
Your choice: Please read this Privacy Policy carefully. If you provide personal information to us, you understand we will collect, hold, use and disclose your personal information in accordance with this Privacy Policy. You do not have to provide personal information to us, however, if you do not, it may affect our ability to do business with you.
Information from third parties: If we receive personal information about you from a third party, we will protect it as set out in this Privacy Policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.
Restrict and unsubscribe: To object to processing for direct marketing/unsubscribe from our email database or opt-out of communications (including marketing communications), please contact us using the details below or opt-out using the opt-out facilities provided in the communication. If you are a creator on Creator Visits, reply STOP to the number we text you from, or email creators@localviews.ai.
Access: You may request access to the personal information that we hold about you. An administrative fee may be payable for the provision of such information. Please note, in some situations, we may be legally permitted to withhold access to your personal information. If we cannot provide access to your information, we will advise you as soon as reasonably possible and provide you with the reasons for our refusal and any mechanism available to complain about the refusal.
Correction: If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us using the details below. We will take reasonable steps to promptly correct any information found to be inaccurate, out of date, incomplete, irrelevant or misleading.
Complaints: If you wish to make a complaint, please contact us using the details below and provide us with full details of the complaint. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take in response to your complaint. If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner.
Your California privacy rights
If you are a California resident, the California Consumer Privacy Act (as amended by the California Privacy Rights Act) gives you certain rights regarding your personal information.
Categories we collect and share. In the past 12 months we have collected identifiers (such as name, email, phone number, and IP address), commercial information, internet and network activity, and inferences, as described in this Privacy Policy. We “share” identifiers and internet activity with advertising platforms such as Meta for cross-context behavioural advertising. We do not knowingly sell or share the personal information of consumers under 16.
Your rights. You have the right to know what personal information we collect and how we use it, to request access to or deletion of your personal information, to correct inaccurate information, and to opt out of the “sale” or “sharing” of your personal information for cross-context behavioural advertising. We will not discriminate against you for exercising these rights.
How to opt out. To opt out of the sharing of your personal information for targeted advertising, you can adjust the advertising settings offered by platforms such as Meta or contact us using the details below. We also honour opt-out preference signals such as the Global Privacy Control (GPC) where technically feasible.
Storage and security
We are committed to ensuring that the personal information we collect is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure personal information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.
While we are committed to security, we cannot guarantee the security of any information that is transmitted to or by us over the Internet. The transmission and exchange of information is carried out at your own risk.
Cookies and tracking technologies
We use cookies and similar tracking technologies on our website to recognise you, understand how our site is used, and deliver and measure our advertising.
Cookies. Cookies are small text files placed in your browser. By themselves they do not identify you, but they recognise you when you return to our site and allow our advertising partners to show you relevant ads on social and online media as part of our retargeting campaigns. If you provide personal information to us, it may be linked to data stored in a cookie.
Analytics. We use analytics tools (including Google Analytics) to understand site usage and improve our website and marketing.
Forms and CRM. Our application forms and related tracking are provided by HubSpot, which may set cookies to associate your form submissions with your visits to our site.
Advertising pixels and server-side tracking. We use advertising and measurement technologies provided by third-party platforms, including the Meta Pixel and Meta’s Conversions API. These technologies collect information about your interactions with our website and ads, including browser and click identifiers (such as Meta’s _fbp cookie and fbclid parameter). Where you have provided it to us, for example when you submit an application or book a call, we may also share certain personal identifiers, such as your email address or phone number, with these platforms. This information is shared in hashed form so the platform can match your activity, measure the performance of our advertising, and help us reach similar audiences. This data may be transmitted both from your browser and directly from our servers.
Your choices. You can block or delete cookies using your browser settings, though some parts of our site may not function properly if you do. You can also manage advertising preferences through the settings offered by platforms such as Meta, and through industry opt-out tools.
Links to other websites
Our website may contain links to other parties’ websites. We do not have any control over those websites and we are not responsible for the protection and privacy of any personal information which you provide whilst visiting those websites. Those websites are not governed by this Privacy Policy.
Amendments
We may, at any time and at our discretion, vary this Privacy Policy by publishing the amended Privacy Policy on our website. We recommend you check our website regularly to ensure you are aware of our current Privacy Policy.
